ACCEPTANCE
By downloading or using TOGYM ("the app"), you agree to these Terms of Use and to our Privacy Policy. If you don't agree, don't use the app.
HEALTH & MEDICAL DISCLAIMER
TOGYM is a fitness tracking and coaching tool, not a medical device and not a substitute for professional medical advice, diagnosis, or treatment. Strength training carries inherent risk. Readiness scores, strain estimates, heart-rate readings, AI coaching, and program suggestions are informational only and may be inaccurate. Consult a physician before beginning any exercise program. Stop and seek medical attention if you experience pain, dizziness, or distress. You train at your own risk.
LICENSE
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by the Apple Media Services Terms and the standard Apple Licensed Application End User License Agreement (EULA), which applies to this app. You may not copy, reverse-engineer, resell, or redistribute the app except as allowed by law.
SUBSCRIPTIONS & BILLING
TOGYM offers an optional auto-renewing "PRO" subscription (monthly or annual) that unlocks AI features and additional programs. Payment is charged to your Apple ID at purchase confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; your Apple ID is charged for renewal within 24 hours before the period ends. Manage or cancel anytime in iOS Settings → your name → Subscriptions. Prices are shown in-app and may vary by region. Refunds are handled by Apple under their policies — we cannot issue them directly. A free tier remains available with no subscription.
AI FEATURES
AI coaching and AI program generation are optional and off unless you enable them. They send a minimal, coarse, non-identifying workout context to an AI provider to produce a response (see the Privacy Policy). AI output is generated automatically, can be wrong, and is not professional advice — apply judgment, and defer to the Health Disclaimer above. You may use your own AI provider API key; you are responsible for that key and any charges it incurs. Daily limits apply to the shared quota.
YOUR DATA & CONTENT
Your workout data lives on your device (see the Privacy Policy). You're responsible for backing it up; deleting the app deletes its on-device data. If you export or share a workout file, you're responsible for what you share and with whom.
ACCEPTABLE USE
Don't use the app to break the law, abuse the AI endpoints (e.g. automated scraping or attempts to exceed quotas), or interfere with the service. We may rate-limit or block abusive traffic.
DISCLAIMERS & LIABILITY
The app is provided "as is" and "as available," without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for injury, loss, or data loss arising from your use of the app. Some jurisdictions don't allow these limits, so they may not fully apply to you.
CHANGES
We may update these terms; material changes will be reflected by the "last updated" date above. Continued use after a change means you accept the revised terms.
